Fire Safety within the home is an extremely important issue, especially in residential premises and where unrelated occupiers, who live independently from one another, live within the same building (albeit, no common parts), such as MAISONETTES +

This includes any building with more than one storey with its own private exit, and within which, there are no internal spaces used by more than one household. A maisonette is a building that meets this criteria and is limited to three storeys (for these legal guidance purposes).

In-brief - The Fire Safety Act 2021 - 

Where a building contains two or more sets of domestic premises, the things to which the order applies includes:

1. The buildings structure & external walls +
2. Doors & windows in those walls +
3. Anything attached to the exterior of those walls + Balconies


In-addition -  

Fire safety features of the maisonette would also be considered such as:

1. The potential of fire spread from one maisonette to another
2. The safe distance of travel within the maisonette +
3. The premises services (gas/ electric) service routines etc.
4. The suitable information sharing between dwelling owners +
5. Suitable liaisons via each dwelling to provide fire safety etc.

The Responsible Person (RP) meaning – 

'Responsible Person' means "the person who has control of the premises in connection with the carrying on of a trade, business or other undertaking".

In practice this will usually be the landlord, but in the case of absentee landlords where the "carrying on of the business" 

is undertaken by a managing agent, it may be the managing agent.

These provisions are enforced by fire and rescue authorities.

9.--(1) The responsible person must make a suitable and sufficient assessment of the risks to which relevant persons are exposed for the purposes of identifying the general fire precautions he needs to take to comply with the requirements and prohibitions imposed on him by or under this order (FSO).
